Booking conditions

Personal Data Processing

In accordance with the provisions of Law 15/1999 of December 13, on the Protection of Personal Data, the user agrees that the personal data provided at the time of booking will be incorporated into a file owned by Compañía Hotelera Andes Plaza, hereinafter the company, with tax ID number 830.012.169-9 and registered office at Avenida 15 Calle 100 Chicó Norte, Bogotá (Colombia), for the management of the booking system, the processing of their request, the control and management of the relationship with the web users who process bookings, as well as for conducting statistical studies of the users registered on the said website to design improvements in the services provided. All fields in the forms marked as mandatory must necessarily be completed for the correct processing of your requests. The personal data provided will only be communicated to third parties in compliance with legal obligations or with your prior consent. The user expressly consents to the use of the provided banking data to address possible penalties for cancellations or no-shows as stipulated in the rate conditions. Processing your bookings necessarily implies the aforementioned processing, so the process cannot be carried out in case of opposition. You may, at any time, exercise your rights of access, rectification, cancellation, or opposition as indicated below.

Accuracy of Data

The user will be responsible, in any case, for the accuracy of the provided data, with the company reserving the right to exclude from registered services any user who has provided false data, without prejudice to other actions that may be taken in law. Additionally, the user must be duly authorized to provide data of third parties. Only if they have the consent of the future hotel guests can the user provide their names and surnames in the Room Distribution section. Such information, which will allow the chosen hotel to provide better service to its guests, is optional, so its provision by the user implies, under their sole responsibility, the assumption of the duty to inform those individuals of the content of our Privacy Policy before offering personal information.

Data Processing during Navigation

In accordance with the obligation provided in Article 22.2 of Law 34/2002 of July 11, on services of the information society and electronic commerce, you are informed that the company uses cookies. A cookie is a piece of text information that websites transfer to the hard drive of connected devices. We use session cookies to identify the user and maintain their identification state. Session cookies are automatically deleted from the hard drive at the end of the session. We also use cookies to collect anonymous and aggregate statistics that allow us to analyze how users use our website, in order to improve it. Only the following information about visitors to our website is obtained and retained:

a) The domain name of the provider (ISP) and/or IP address that provides access to the network. For example, a user from provider xxx will only be identified with the domain xxx.es and/or the IP address. This way, we can compile statistics about the countries and servers that visit our website most often.

b) The date and time of access to our website. This allows us to determine peak hours, and make precise adjustments to avoid saturation problems during peak times.

c) The internet address from which the link that leads to our website originated. Thanks to this data, we can understand the effectiveness of the different banners and links pointing to our server, in order to enhance those that offer better results.

d) The number of daily visitors to each section. This allows us to understand which areas are most successful and increase and improve their content so that users achieve a more satisfactory result.

We will obtain the following information:

a) The date and time of the last time the user visited our website.

b) The content design that the user chose during their visit to our website.

c) Security elements involved in controlling access to restricted areas.

While the information obtained is, in principle, entirely anonymous, according to Report 327/2003 of the Spanish Data Protection Agency, users are informed that the aforementioned data will be incorporated into a personal data file owned by the company for the previously detailed purposes, and the user may exercise their rights of access, rectification, cancellation, and opposition as indicated below.

We also use the Google Adwords remarketing tool. This tool allows us to publish ads based on previous visits to our website on the Google Adwords Content Network (more details about the Google Content Network here: https://support.google.com/adwords/answer/2404190). To do this, some pages of our website include a code called “remarketing tag”. These tags allow us to read and configure your browser cookies to determine the specific type of ad to be shown to you based on elements related to your visit to our website, such as the browsing circuit chosen, specific pages visited, or actions taken on those pages. The remarketing lists created in this way are stored in a database on Google’s servers, where all cookie IDs associated with each list or interest category are stored. The information obtained only allows the identification of a specific browser and does not allow Google to identify a specific user solely with this information (more information about the Remarketing tool at the following link: https://www.google.com/adwords)

Regarding the company, this information can only be associated with a specific user if the user is identified on the website, for example, by completing a booking process. In this case, the data thus obtained will be communicated to the company for commercial prospecting and user segmentation purposes to design marketing campaigns according to the interests shown during navigation. The data will be incorporated into a file of the mentioned entity for the stated purposes. To oppose the aforementioned processing and communication, the user has the option to disable cookies as follows:

The user has the option not to receive cookies or to be informed about their setting through their browser configuration. However, if you disable cookies, you may not be able to use all the website’s functionalities. Regarding remarketing cookies, the user can disable the use of Google cookies by visiting the Google ad opt-out page. You can also disable DoubleClick cookies by visiting the DoubleClick opt-out page (in English). To disable third-party cookies, users can also visit the Network Advertising Initiative (NAI) opt-out page (in English). Users can exercise their rights of access, rectification, cancellation, and opposition at any time as indicated below.

Hotel Responsibility

Access to the website does not imply the existence of a commercial relationship between the user and the company. The portal only provides information about available hotel rooms at the time of the request for the mentioned information, so if you make an online booking, you are contracting directly with the hotel and not with the portal. The printed version of the booking serves as a locator when you arrive at the hotel.

Booking hotel nights on this website implies the client’s adherence and acceptance of all the general conditions outlined here.

By accepting the following clauses, you declare and accept:

1) You are of legal age and have full capacity to make the booking, stating that you understand and comprehend all the conditions on the website.

2) The data provided when making the online booking are true, complete, and concise.

3) Only those pages included within the sitemap are covered on the website.

4) Access to this website is the user’s responsibility.

5) Once the booking is made, the electronic document in which it was formalized will be filed, and you may access it at any time.

6) You confirm the booking made, that is, the indicated dates, number of rooms, people, and the chosen hotel.

7) The conditions and price of the booking are those expressly determined in the rate conditions included on the booking page.

8) Regarding the relationship with the portal, it gives you the possibility to book rooms at the chosen hotel through its website but does not offer any hotel services under its responsibility.

9) The card data are collected to guarantee the booking. Payment will be made in cash at the chosen hotel, and only in the case of cancellations or no-shows will the booking be canceled, and the fee charged as specified in the rate conditions.

10) Offers are only valid for the time they remain accessible to the service recipients.

Prices

The indicated prices are Public Sale Prices, including VAT.

The price includes: Price per night depending on the type of room and selected board, except for hotels that specifically indicate the inclusion of other services.

The price does not include: Any unspecified service, as well as extras such as transfers, tips, phone calls, laundry services, minibar, parking, etc.

Check-in and check-out times: As a general rule, and unless otherwise agreed with the establishment, rooms can be used from 2 p.m. on the day of arrival and must be vacated by 12 noon on the day of departure.

Passports and Visas

All travelers, without exception (including children), must carry their corresponding personal and family documentation in order, whether a passport or ID, according to current legislation. It is the responsibility of travelers to obtain visas, passports, vaccination certificates, etc. when required by travel. Minors under 18 must carry a written permission signed by their parents or guardians, in anticipation of it being requested by any authority. If a visa is denied by any authority due to the user’s personal reasons, or if entry to the country is denied for failing to meet the required conditions, or for lack of the necessary documentation, or for not carrying it, the hotel declines all responsibility for such events, and any expenses incurred will be borne by the consumer, applying the conditions and rules established for no-shows in these circumstances.
